2. Intellectual property

All content on kidbuddy.com — including text, images, logos, graphics, videos, the KidBuddy brand and the site structure — is the exclusive property of KidBuddy or its partners, and is protected by Canadian and international intellectual property laws.

Any reproduction, distribution, modification or use of this content, in whole or in part, without prior written permission from KidBuddy is strictly prohibited.

3. Accuracy of information

We make every effort to ensure that information on the site (product descriptions, prices, availability, technical specifications) is accurate and up to date. However, errors or omissions may occur. KidBuddy reserves the right to correct any error and to modify site content at any time without notice.

Product images are provided for illustrative purposes and may differ slightly from the product received.

4. Intended use and supervision

GPS watches distributed by KidBuddy are location and communication assistance tools. They are in no way a fail-safe security device or a standalone surveillance tool.

They should never be used as the only means of ensuring the safety, supervision or protection of a child. Responsible and appropriate adult supervision remains essential at all times.

5. No real-time location guarantee

GPS location depends in particular on:

• available cellular coverage;
• availability of the GPS satellite signal;
• the environment (indoors, basement, building, wooded area, metal structure, etc.);
• proper operation of the mobile operator’s network;
• battery charge level;
• the device’s software configuration.

As a result, location may be delayed, inaccurate, intermittent or temporarily unavailable. KidBuddy does not guarantee continuous, accurate or real-time location.

6. Network coverage and compatibility

Prior verification. It is the buyer’s responsibility to verify before purchase that the intended usage areas are covered by a compatible cellular network (LTE 4G).

Network disclaimer. KidBuddy is not responsible for malfunctions or limitations resulting from insufficient cellular coverage, weak or unstable signal, mobile network outage or interruption, technical changes made by an operator, IMEI blocking or activation refusal by an operator, or SIM incompatibility beyond our control.

Operator compatibility. Canadian mobile networks are evolving, notably with the gradual retirement of 3G networks and the spread of VoLTE technology. These changes may affect the compatibility of devices that are not traditional cell phones, such as children’s smartwatches. It is the customer’s responsibility to verify with their mobile operator before purchasing the watch that the SIM supports VoLTE, that the plan includes mobile data and that the device is allowed on the operator’s network.

Liability limits. KidBuddy cannot be held liable for incompatibilities related to a SIM card or plan provided by another mobile operator, for activation, connection or operation refusal by a mobile operator, or for fees, subscriptions or contractual commitments entered into with another mobile operator.

7. Battery and power

Proper operation of the device depends on a adequately charged battery. KidBuddy is not responsible for a discharged device, reduced autonomy due to use, damage caused by use of a non-compliant charger, or damage resulting from a power surge. Use of a power adapter meeting the recommended specifications is mandatory.

8. General limitation of liability

To the extent permitted by applicable law, KidBuddy disclaims liability for:

• accident, injury, disappearance, loss;
• property damage, indirect or consequential damage;
• moral prejudice, loss of data, financial loss, death;

resulting directly or indirectly from the use, inability to use or misuse of products or services.

In any event, KidBuddy’s maximum liability is strictly limited to the amount paid for the relevant product or service.

9. Proper use and user obligations

The user agrees to:

• use the product in accordance with the instructions provided;
• keep the device up to date;
• ensure that the SIM card and plan are active;
• comply with applicable privacy and surveillance laws.

Any use contrary to applicable laws is solely the user’s responsibility.

10. Force majeure

KidBuddy cannot be held liable for any delay or failure to perform resulting from a force majeure event, including but not limited to: network failure, natural disaster, labour dispute, interruption of third-party services, regulatory decision, cyberattack or infrastructure failure.

11. Services, plans and subscriptions

The terms applicable to services, plans and subscriptions (activation, billing, cancellation, non-refund), including suspension or termination of service, are described in our Terms and Conditions of Sale, which prevail in case of discrepancy.

12. Protection of personal information

KidBuddy attaches great importance to the protection of your personal information, in accordance with applicable laws in Quebec and Canada. Details about the collection, use and retention of your data are set out in our Privacy Policy.

The site may contain links to third-party sites. KidBuddy has no control over these sites and disclaims all responsibility for their content or practices.

14. Applicable law

These legal notices are governed by the laws in force in the province of Quebec and the applicable laws of Canada. Any dispute relating to use of the site falls within the exclusive jurisdiction of the courts of the judicial district of Quebec, province of Quebec.

15. Modifications

KidBuddy reserves the right to modify these legal notices at any time. The version in force is the one published on the site at the date of your visit.
